These Terms govern access to and use of the SMTP Provider Shopify application, website, dashboard, email sending tools, automation features, and related services.

Welcome to SMTP Provider. These Terms and Conditions govern your access to and use of the SMTP Provider Shopify application, website, dashboard, email sending tools, automation features, and related services.

By installing, accessing, or using SMTP Provider, you agree to these Terms. If you do not agree, please do not use our services.

1. About SMTP Provider

SMTP Provider is an email marketing and SMTP delivery platform built for Shopify merchants. Our services may include email campaigns, automation flows, abandoned cart recovery, browse abandonment emails, checkout recovery, customer segmentation, popup forms, templates, analytics, SMTP sending, dedicated IP options, and related support services.

2. Eligibility

To use SMTP Provider, you must:

  • Be at least 18 years old.
  • Own, manage, or be authorized to operate a Shopify store.
  • Provide accurate account and billing information.
  • Use the service only for lawful business purposes.

You are responsible for all activity under your account.

3. Shopify Store Connection

When you install SMTP Provider on your Shopify store, you authorize us to access selected store data required to operate the service. This may include customer information, order details, product data, cart and checkout events, marketing consent status, and store settings.

We use this data only to provide app functionality, such as syncing customers, creating segments, sending automations, tracking campaign performance, and reporting revenue generated through emails.

4. Email Sending Rules

You agree to send emails only to recipients who have given valid consent or where you have another lawful basis to contact them.

You must not use SMTP Provider to:

  • Send spam or unsolicited bulk email.
  • Use purchased, scraped, rented, or third-party email lists.
  • Send phishing, fake, fraudulent, misleading, or harmful messages.
  • Impersonate another brand, company, or person.
  • Send malware, viruses, or harmful links.
  • Violate CAN-SPAM, GDPR, CASL, PECR, India IT Rules, or other applicable email, privacy, or anti-spam laws.
  • Send content related to illegal products, scams, hate speech, adult exploitation, or other prohibited activities.

We may suspend or terminate your account if we detect abuse, excessive bounce rates, spam complaints, blacklisting risk, or policy violations.

5. Merchant Responsibility

You are responsible for:

  • The accuracy of your sender details.
  • The content of your emails.
  • Ensuring your customers have opted in where required.
  • Including a valid unsubscribe option where required.
  • Honoring unsubscribe, suppression, and deletion requests.
  • Complying with all laws that apply to your business and customers.

SMTP Provider provides tools, but you remain responsible for how you use them.

6. Deliverability

SMTP Provider works to support reliable email delivery through SMTP infrastructure, domain authentication, bounce handling, monitoring, and sending best practices.

However, inbox placement cannot be guaranteed. Delivery may be affected by recipient mail servers, spam filters, customer engagement, sender reputation, domain reputation, email content, authentication setup, and third-party systems.

7. Plans, Billing, and Payments

Paid plans are billed according to the pricing shown on our website, Shopify App Store listing, or within the app dashboard.

Billing may be processed through Shopify Billing or another approved payment provider. By selecting a paid plan, you authorize recurring charges until the subscription is cancelled.

Plan limits may include email volume, contacts, automation features, dedicated IP access, support level, or other usage limits. If you exceed your plan limits, you may need to upgrade or purchase additional usage.

8. Free Trial and Free Plan

We may offer a free plan, trial, or promotional credits. Free access may be limited by contacts, email volume, features, or time period. SMTP Provider may modify or withdraw free plans, trials, or promotional offers at any time.

9. Cancellations and Refunds

You may cancel your subscription at any time through Shopify or your SMTP Provider account. Unless required by law or specifically agreed in writing, fees already charged are non-refundable. After cancellation, your access to paid features may continue until the end of the billing period.

10. Account Suspension or Termination

We may suspend or terminate your access if:

  • You violate these Terms.
  • Your account causes deliverability, spam, security, or infrastructure risk.
  • Payment fails or remains overdue.
  • You misuse customer data.
  • You use the platform for illegal or harmful activity.

We may also pause sending temporarily to protect your domain, our infrastructure, or other users.

11. Data Ownership

You retain ownership of your store data, customer data, campaign content, and uploaded materials. SMTP Provider does not sell your customer data.

You grant us permission to process your data only as needed to provide the service, improve platform functionality, prevent abuse, and comply with legal obligations.

12. App Uninstall and Data Deletion

If you uninstall SMTP Provider from your Shopify store, we may retain limited data for a reasonable period for backup, legal, fraud prevention, billing, or compliance purposes.

You may request deletion of eligible account and customer data by contacting us through the contact form or dashboard support.

13. Third-Party Services

SMTP Provider may integrate with Shopify, payment processors, analytics tools, email infrastructure providers, hosting providers, and support tools.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party service failures, outages, or policy changes.

14. Intellectual Property

SMTP Provider, including its software, dashboard, website, branding, templates, designs, and technology, is owned by SMTP Provider or its licensors.

You may not copy, resell, reverse engineer, modify, or misuse our platform without written permission.

15. Service Availability

We aim to provide reliable service, but we do not guarantee uninterrupted access. Maintenance, technical issues, third-party outages, infrastructure failures, or security events may affect availability.

16. Limitation of Liability

To the maximum extent permitted by law, SMTP Provider shall not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

Our total liability for any claim shall not exceed the amount paid by you for the service during the three months before the claim.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised Last Updated date. Continued use of SMTP Provider after changes means you accept the updated Terms.
