Anti-Spam Policy

SMTP Provider is committed to responsible email marketing. We have a strict zero-tolerance
policy towards spam. This Anti-Spam Policy outlines what constitutes spam, the standards
we expect our Merchants to uphold, and the consequences of non-compliance.
All Merchants using our Services must comply with this policy, in addition to applicable
laws including the CAN-SPAM Act (USA), CASL (Canada), GDPR (EU), and India's IT Act
and IT Rules.
1. Definition of Spam
Spam refers to unsolicited bulk email sent to recipients who have not explicitly consented
to receive communications from the sender. For the purposes of this policy, spam includes:
- Emails sent to purchased, rented, or harvested email lists.
- Emails sent without a legitimate prior business relationship or express consent.
- Emails that use deceptive subject lines, misleading headers, or false sender information.

Emails that do not include a valid physical postal address or a functioning unsubscribe
mechanism.
- Emails that ignore or fail to honor opt-out requests within 10 business days.
- Emails promoting illegal products, services, or activities.
2. Merchant Obligations
As a Merchant using our Services, you are solely responsible for the emails you send.
You must:

Only send emails to subscribers who have given clear, documented consent, also known
as opt-in consent, to receive communications from your Shopify store.
- Maintain accurate records of consent for all subscribers on your lists.
- Include a clear and conspicuous unsubscribe link in every marketing email.
- Honor all unsubscribe requests promptly, within 10 business days at most.
- Include your valid physical mailing address in every email.

Ensure that all From, To, Reply-To, and subject line information is accurate and not
deceptive.

Do not use our Services to send emails on behalf of third parties without proper
authorization.

Immediately remove any email address from your list upon a bounce, unsubscribe,
or spam complaint.
3. List Hygiene Requirements
Maintaining clean, high-quality email lists protects your deliverability and protects other
Merchants on our platform. You must:
- Never use purchased, rented, appended, or scraped email lists.
- Regularly remove inactive subscribers and bounced email addresses.
- Use double opt-in, also known as confirmed opt-in, where possible to ensure subscriber quality.
- Never add someone to your list who has previously unsubscribed.
- Do not import lists from sources that do not meet our consent standards.
4. Prohibited Content
The following types of email content are prohibited on our platform:
- Deceptive or misleading subject lines and headers.
- Content promoting multi-level marketing (MLM), pyramid schemes, or get-rich-quick offers.
- Adult, sexually explicit, or obscene content.
- Malware, viruses, ransomware, or any harmful code.
- Phishing, spoofing, or any form of identity deception.
- Content promoting illegal products, firearms, drugs, or other prohibited items.

Hate speech or content targeting individuals or groups based on protected characteristics.
5. Complaint Handling
SMTP Provider monitors spam complaint rates across all Merchant accounts.
Industry-standard best practice requires that complaint rates remain below 0.1%.
If your complaint rate exceeds acceptable thresholds:
- We will notify you and require you to take corrective action.
- We may temporarily pause your sending capabilities pending investigation.

Repeated violations or complaint rates above 0.3% may result in permanent account
suspension.
6. Enforcement
We reserve the right to take the following actions if we determine, in our sole discretion,
that your use of the Services violates this Anti-Spam Policy:
- Issuance of a warning and requirement to correct the violation.
- Temporary suspension of sending capabilities.
- Permanent suspension or termination of your account.
- Reporting violations to relevant authorities where required by law.
Account terminations for spam violations are not eligible for refunds.
7. Reporting Spam
If you receive an email that you believe was sent through our platform without your consent,
or if you wish to report a Merchant that you believe is violating this policy, please contact us at
